# Terms of Service

## Overview
This website is operated by True Love Threads, a business of Mountain House Embroidery and Design (collectively, “True Love Threads,” “we,” “us,” or “our”). We offer this website, including all information, tools, products, and services available through it (the “Services”), to you conditioned upon your acceptance of these Terms of Service (“Terms”).
By visiting our website, placing an order, submitting a custom request, or otherwise using the Services, you agree to these Terms and to the policies referenced in them, including our [Privacy Policy](https://truelovethreads.com/policies/privacy-policy), [Refund Policy](https://truelovethreads.com/policies/refund-policy), and [Shipping Policy](https://truelovethreads.com/policies/shipping-policy). If you do not agree, do not use the Services.
Our store is hosted by Shopify, which provides the online commerce platform that allows us to offer our products and Services to you.
## 1. Eligibility and Accounts
You must be at least the age of majority in your state or province of residence to use the Services or place an order. If you allow a minor dependent to use the Services, you are responsible for their use.
You agree to provide current, complete, and accurate account, billing, shipping, and order information. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us promptly if you believe your account has been used without authorization.
You may not use the Services for any unlawful or unauthorized purpose or violate any applicable law while using them.
## 2. Products and Availability
We make reasonable efforts to display product descriptions, colors, embroidery, placement, dimensions, and images accurately. However, colors and details may appear differently depending on your screen, lighting, garment manufacturer, material, dye lot, size, or other production variables. Minor variations are normal and are not defects.
Many of our products are made to order, customized, or personalized. Product availability, materials, colors, sizes, and designs may change without notice. We may limit quantities, discontinue products, or refuse or cancel an order when reasonably necessary.
We do not guarantee that every product, color, size, or design shown will remain available. If a selected item becomes unavailable, we may contact you to approve a comparable substitute or issue a refund for the unavailable item.
## 3. Custom and Personalized Orders
You are responsible for reviewing all names, dates, spellings, sizes, colors, design choices, uploaded files, and other personalization details before submitting your order. We are not responsible for errors contained in information that you approved or provided.
Once production begins, changes or cancellations may not be possible. If you need to request a change, contact us immediately at mountainhouseembroidery@gmail.com. We will try to help, but we cannot guarantee that a requested change can be made.
If we provide a proof or mockup for approval, you are responsible for reviewing it carefully. Your approval authorizes us to produce the item as shown. Mockups are visual guides and may not represent exact scale, thread color, placement, or final appearance.
For customer-supplied garments or materials, production is performed at the customer’s risk. Embroidery and related processes can occasionally cause damage due to fabric construction, previous wear, coatings, hidden defects, or other conditions outside our control. To the fullest extent permitted by law, our responsibility for accidental damage to a customer-supplied item will not exceed the reasonable replacement value of that item.
## 4. Customer-Provided Content and Intellectual Property Rights
When you submit artwork, logos, photographs, text, names, trademarks, or other content (“Customer Content”), you represent that you own it or have all permissions necessary for us to reproduce, modify, embroider, print, display, and otherwise use it to fulfill your request.
You grant True Love Threads a limited, non-exclusive license to use Customer Content solely to communicate with you, prepare proofs, produce your order, provide support, and maintain appropriate business records. You remain responsible for Customer Content and for any claim that it infringes another person’s intellectual property, privacy, publicity, or other rights.
We may decline or cancel requests that we reasonably believe are unlawful, infringing, hateful, threatening, deceptive, or otherwise inappropriate. You agree to indemnify True Love Threads as described in Section 18 for claims arising from Customer Content you provide.
## 5. Orders, Acceptance, and Cancellation
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean we have accepted the order. We may accept, reject, limit, or cancel an order for reasons including suspected fraud, pricing or inventory errors, inability to obtain materials, prohibited Customer Content, or misuse of the Services.
If we cancel an order after payment has been processed, we will refund the amount charged for the canceled portion to the original payment method. We may limit or cancel orders that appear to be placed by resellers, distributors, or dealers unless we have agreed otherwise in writing.
## 6. Prices, Payments, and Billing
Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes, shipping charges, and other applicable fees will be displayed at checkout when required. The price charged is the price shown when your order is submitted, except in the case of an obvious error.
You represent that the payment information you provide is accurate and that you are authorized to use the selected payment method. You agree to pay all charges associated with your order. Payment services may be provided by Shopify or third-party processors and may be subject to additional terms.
Discounts, promotions, and coupon codes may be limited, modified, or discontinued at any time and cannot be combined unless expressly stated.
## 7. Shipping, Delivery, and Pickup
Shipping and delivery are governed by our [Shipping Policy](https://truelovethreads.com/policies/shipping-policy). Processing and delivery dates are estimates, not guarantees. Delays may occur because of production volume, material availability, carrier performance, weather, holidays, incorrect addresses, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect or incomplete address, refusal, or unclaimed package may be your responsibility to the extent permitted by law.
If an order arrives damaged, appears lost, or has another delivery problem, contact us promptly so we can review the issue and assist with the available carrier process. Nothing in these Terms limits rights that cannot legally be limited.
## 8. Returns, Exchanges, and Refunds
Returns, exchanges, cancellations, defects, and order issues are governed by our [Refund Policy](https://truelovethreads.com/policies/refund-policy). Because most products are made to order or personalized, sales are generally final except as stated in that policy or required by law.
Please inspect your order upon delivery and contact us within the time stated in our Refund Policy if an item is incorrect, damaged, or defective. Include your order number and clear photographs when applicable.
## 9. School, Organization, and Fundraising Collections
Certain collections may be created for a school, parent organization, team, group, or community fundraiser. Any contribution or fundraising amount will be described on the relevant collection or promotional materials. Unless expressly stated otherwise, True Love Threads is an independent local business and is not owned, operated, or officially endorsed by the referenced school or organization.
Product purchases are transactions with True Love Threads. Questions about an order, product, payment, shipping, or refund should be directed to us, not to the school or organization.
## 10. Our Content and Intellectual Property
The Services and their content—including our branding, designs, photographs, graphics, text, videos, arrangement, and website materials—are owned by or licensed to True Love Threads and are protected by applicable intellectual property laws.
These Terms give you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial shopping purposes. You may not copy, reproduce, modify, distribute, sell, license, scrape for commercial exploitation, or create derivative works from our content without written permission, except as allowed by law.
Nothing in these Terms transfers ownership of any True Love Threads or third-party intellectual property to you.
## 11. Third-Party Tools, Services, and Links
The Services may include tools, integrations, payment options, links, or content provided by Shopify or other third parties. We do not control all third-party services and provide access to them on an “as available” basis.
Your use of a third-party service may be governed by that provider’s terms and privacy policy. We are not responsible for third-party websites, products, services, content, or transactions except to the extent required by law. Review the applicable third-party terms before using them.
## 12. Privacy

Because Shopify hosts our store, Shopify may also collect and process information relating to your use of the Services. ## 13. Reviews, Feedback, and Submissions
If you submit a review, comment, suggestion, photograph, testimonial, or other feedback (“Feedback”), you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, edit, publish, translate, and display that Feedback for business and promotional purposes, subject to applicable law and our Privacy Policy.
You represent that your Feedback is truthful, does not violate another person’s rights, and is not unlawful, abusive, defamatory, obscene, or misleading. We may remove Feedback at our discretion, but we have no obligation to monitor all submissions.
## 14. Prohibited Uses
You may not use the Services to:
- violate any law or another person’s rights;
- submit false, fraudulent, misleading, infringing, or malicious content;
- transmit viruses, malware, or other harmful code;
- interfere with the security, availability, or operation of the Services;
- collect or track another person’s personal information without authorization;
- spam, phish, impersonate, harass, abuse, or discriminate against another person;
- bypass access, purchase, or security restrictions; or
- use the Services or our content for unauthorized commercial exploitation.
We may suspend or terminate access for conduct that violates these Terms.
## 15. Errors and Corrections
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, availability, or other information. We may correct errors, update information, or cancel affected orders when reasonably necessary, including after an order has been submitted.
If a pricing or product error affects your order, we will notify you when practical and provide an appropriate correction, cancellation, or refund. We are not obligated to update every item of information except as required by law.
## 16. Disclaimer of Warranties
To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” without warranties or conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee that the Services will always be uninterrupted, secure, timely, or error-free, or that every result obtained through the Services will be accurate or reliable. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms excludes warranties or consumer rights that cannot be excluded under applicable law.
## 17. Limitation of Liability
To the fullest extent permitted by law, True Love Threads and its owners, employees, contractors, suppliers, service providers, licensors, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, lost data, replacement costs, or similar damages arising from your use of the Services or purchase of products.
To the fullest extent permitted by law, our total liability for any claim arising from an order, product, or the Services will not exceed the amount you paid to True Love Threads for the product or order giving rise to the claim.
These limitations apply regardless of the theory of liability, but do not apply where prohibited by law or to liability that cannot legally be limited.
## 18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless True Love Threads, Mountain House Embroidery and Design, Shopify, and our respective owners, affiliates, employees, contractors, service providers, and licensors from claims, damages, liabilities, losses, and reasonable costs arising from: (a) your breach of these Terms; (b) your violation of law or another person’s rights; (c) Customer Content or Feedback you provide; or (d) your misuse of the Services.
We may control the defense of a claim subject to indemnification, and you agree to cooperate reasonably with that defense.
## 19. Termination
You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk or legal exposure, or misused the Services.
Termination does not affect rights or obligations that arose before termination, including payment obligations. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will remain in effect.
## 20. Severability; Waiver; Entire Agreement
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver of that provision. These Terms and the policies referenced in them constitute the entire agreement between you and True Love Threads concerning the Services and replace prior agreements or communications on the same subject.
Headings are provided for convenience and do not affect interpretation.
## 21. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, sale, reorganization, financing, or transfer of all or part of our business, subject to applicable law.
## 22. Governing Law
These Terms and any separate agreements for Services are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles. Any dispute will be brought in a court with appropriate jurisdiction in California, unless applicable law requires otherwise.
## 23. Changes to These Terms
We may update these Terms by posting a revised version on this page. Changes take effect when posted unless a later date is stated. Your continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
The “Last updated” date at the top identifies the most recent revision. Please review these Terms periodically.
